REGULATIONS OF THE COMPETITION ON INSTAGRAM UNDER THE NAME “SHARE 2 WIN”

§1 General Provisions

  1. The Organizer of the Competition is Morgan sp. z o.o. with its registered office at Przytkowice 532A, 34-141 Przytkowice, identified by the NIP number 5512379554, REGON number 356872520 KRS number 0000216725, share capital PLN 1,795,000.00, hereinafter referred to as the “Organizer”.
  2. The competition is conducted on the terms described in these Regulations in accordance with generally applicable provisions of Polish law.
  3. The competition starts on May 22, 2024. 18:00 and ends on May 31, 2024. at 23:59:59 Polish time.

§2. Participants and rules of the Competition

  1. Participation in the Competition is voluntary and free of charge.
  2. The Competition may be participated by a natural person (consumer within the meaning of Article 22 of the Civil Code), hereinafter referred to as the Participant, who:
    a) has read and accepted these Regulations and consented to the processing of personal data for the purpose of conducting the Competition by registering to participate in the Competition;
    b) is over 18 years of age and has full legal capacity;
    c) having an address for delivery in the territory of the Republic of Poland,
    d) has a public account (profile) on Instagram,
    e) complete the Competition Task.
  3. Only a person who meets the conditions specified in §2 may participate in the Competition. paragraph 2 of the Regulations.
  4. Employees of the Organizer and entities and employees of entities providing services to the Organizer in organizing the Competition under civil law contracts, as well as members of the immediate family (spouses, ascendants, descendants and siblings) of the above-mentioned persons are excluded from participation in the Competition.
  5. In order to take part in the Competition, during its duration, the Participant will complete the Competition Task of posting a Post/Story with a competition photo on Instagram on their public account.
  6. Completion of the Competition Task means posting on Instagram by the Competition Participant any form of creative expression, in particular such as: photography, audiovisual work, collage, drawing, GIF possible to post on Instagram and in accordance with the Istangram regulations. posting a comment under the competition post on Instagram at the URL: www.blendbrothers.pl/contests in response to the question:
    Tag two friends who should win the package.
  7. Only Participants who will complete the Competition Task during the Competition will take part in the Competition.
  8. The Participant may take part in the Competition only 1 (in words: one) time.
  9. The Organizer reserves the right to remove and not include in the Competition completed Competition Tasks whose authors:
    a) they do not act on their own behalf, but through third parties,
    b) operate from fictitious accounts/profiles on Instagram;
    c) create fictitious accounts/profiles on Instagram;
    d) violate Instagram’s regulations.
    e) used in the Competition Task words generally considered offensive, pornographic content, content promoting racial, ethnic and religious hatred or discriminating against social groups, violated the personal rights of persons or third parties or the Organizer.§ 3 Rights to completed Competition Tasks

§ 3 Rights to completed Competition Tasks

  1. The Participant ensures that the completed Competition Task will not violate any rights or goods of the Organizer, persons and third parties, in particular their property and personal copyrights and personal rights.
  2. The Participant declares that he or she is entitled to exclusive and unlimited copyright to the completed Competition Task and that the completed Competition Task is not encumbered with any third-party rights and that the work has not been previously published.
  3. Pursuant to Art. 921 § 3 of the Civil Code, the Organizer reserves the right, upon issuing the Prize, to acquire a non-exclusive license to the Competition Task awarded in the Competition without time and territorial limits, and the awarded Competition Participant (Winner) grants the Organizer a non-exclusive license to the awarded Competition Task in the following fields of use:
    a) in the scope of recording and reproducing the work – producing copies of the work using a specific technique, including printing, reprographic, magnetic recording and digital techniques;
    b) in the scope of trade in the original or copies on which the work was recorded – placing on the market, lending or renting the original or copies;
    c) in the scope of disseminating the work in a manner other than that specified in point b – public performance, exhibition, display, reproduction, broadcasting and rebroadcasting, as well as making the work publicly available in such a way that everyone can have access to it at a place and time by themselves selected, including entering the work into computer memory and into telecommunications and IT networks.

§4. Prizes and selection of winners

  1. To ensure the correct conduct of the Competition, the Organizer will appoint a 3-person Commission, hereinafter referred to as the Competition Commission. The tasks of the Competition Committee will include supervising the correct course of the Competition, making decisions on all issues related to the Competition, including the interpretation of the provisions of these Regulations and selecting the Participants who will be awarded Prizes (hereinafter referred to as the Winners). The Commission’s decisions are final, which does not deprive the Participant of the right to pursue claims under the law.
  2. After the end of the Competition, the Competition Committee will evaluate the Competition Tasks completed by the Participants and select 1 (in words: one) Winners among the Participants who, in the opinion of the Competition Committee, will perform the Competition Task in the most attractive, original and creative way.
  3. The competition winners will be awarded the following prizes:
    a) First Prize – products worth PLN 1,350 (in words: one thousand three hundred and fifty zlotys),
    b) Second Prize – products worth PLN 1,350 (in words: one thousand three hundred and fifty zlotys)
    c) Third Prize – products worth PLN 1,350 (in words: one thousand three hundred and fifty zlotys)
  4. Prizes are exempt from personal income tax pursuant to Art. 21 section 1 point 68 of the Personal Income Tax Act.
  5. The Commission will finish selecting the Winners no later than June 1, 2024.
  6. The Competition Winners will be informed about receiving the Prize by posting a list of Winners indicating the names of their profiles (accounts) on the Organizer’s profile on Instagram Blendbrothers_official (profile name or link) no later than June 1, 2024.
  7. Information about winning the Competition will be sent to the Winners in a private message on Instagram.
  8. The condition for receiving the Prize is that the Winner provides the Organizer, within 14 days from the date of sending by the Organizer, an e-mail to the following address: support@blendbrothers.pl, information necessary to provide the Prize, including in particular: name, surname, e-mail address and correspondence address in the territory of the Republic of Poland.
  9. If the Winner fails to submit within the time limit and on the terms specified in section 7 above the data necessary to transfer the Prize, the Competition Committee will select the next Participant to receive a given Prize.
  10. The Organizer is not responsible for failure to deliver the Prize to the Participant if the inability to deliver the Prize resulted solely from the Participant’s failure to provide the data required to deliver the Prize or by providing incorrect or inconsistent data.
  11. Each Prize will be sent once by the Organizer to the address indicated by the Winner in the territory of the Republic of Poland within 7 days from the date of sending by the Winner in response to information about the Prize awarded all data enabling the shipment of the Prize.
  12. The founder of the Prizes is the Organizer.
  13. The winner cannot transfer the rights to the awarded prize to a third party.
  14. The winner has the option of waiving the right to the Prize awarded to him by submitting an appropriate written declaration to the Organizer.
  15. You can receive the Prize only 1 (one) time in the Competition
  16. The prize will be sent to the Participant at the Organizer’s expense.
  17. The Participant has no right to request the Prize be exchanged for a cash prize.

§5. Personal data

  1. The administrator of the Participants’ personal data is the Organizer. Contact with the organizer is possible by correspondence to the correspondence address 34-141 Przytkowice, Przytkowice 532A_ and to the e-mail address support@blendbrothers.pl
  2. The basis for the processing of personal data is Art. 6 section 1 letter a GDPR, the Participants’ consent to participate in the Competition and Art. 6 section 1 letter f, i.e. the legitimate interest of the administrator, in particular in the scope of examining complaints and pursuing claims.
  3. Participants’ personal data will be processed to the extent and for the purpose necessary to conduct the Competition, select the Winners, consider any complaints and, in the case of Winners, also notify about the award of the Prize and issue the Prize.
  4. Providing personal data is voluntary, however, it is a condition for issuing the Prizes to the Winners or submitting a complaint regarding identification and address data.
  5. Personal data will be stored for the duration of the Competition, and after its completion until the limitation period for any claims expires or the obligation to store data resulting from legal provisions expires, no longer than for 5 years from the end of the calendar year in which the Competition was held.
  6. The Organizer realizes the rights of data subjects, i.e. access to the content of their data and the right to rectify, delete, limit their processing, and the right to transfer data.
  7. In the case of personal data processing based on consent, the Participant has the right to withdraw consent at any time, and the withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Withdrawal of consent requires electronic notification to the e-mail address support@Blendbrothers.pl
  8. The recipients of the data are: entities providing hosting services, postal services, entities with which the Organizer cooperates as part of accounting and tax services, public authorities on the basis and within the limits of the law, in particular such as the National Tax Administration, law enforcement authorities.
  9. Personal data is not processed automatically and is not subject to profiling.

§ 6. Complaints

  1. Competition Participants have the right to submit a written complaint with the note “Complaint: Share 2 Win 1 Competition to the e-mail address support@blendbrothers.pl or the Organizer’s correspondence address 34-141 Przytkowice, Przytkowice 532A related to the course of the Competition during its duration, and also up to 14 days after the end of the Competition.
  2. The letter containing the complaint should indicate the name and surname of the Participant and the correspondence address to which the response to the complaint will be sent.
  3. The Organizer will provide the Participant with a response to the complaint within 14 days by registered letter sent to the address provided in the letter containing the complaint.
  4. A negative consideration of the Participant’s complaint by the Organizer does not exclude the Participant’s right to pursue claims under generally applicable provisions of law, including through court proceedings.

§7. Final provisions and technical information.

  1. The Regulations enter into force on May 22, 2024.
  2. The competition is not a promotional lottery within the meaning of Art. 2 section 1 point 9 of the Act on games and betting of July 29, 1992 (Journal of Laws of 2004, No. 4, item 27, as amended) and is not subject to the rules contained in the above-mentioned. Act and implementing regulations to this Act.
  3. The Competition Organizer is not responsible for the inability of a potential Participant to send the completed Competition Task for reasons solely attributable to the Participant.
  4. The Competition Regulations are available during the Competition via the Internet public IT network at the URL address: www.blendbrothers.pl/contests OR at the Organizer’s office.
  5. The Organizer undertakes to make every effort to amicably settle any disputes that may arise in connection with the conduct of the Competition.
  6. The court competent to resolve disputes is the court with local and subject-matter jurisdiction in accordance with the provisions of law.
  7. This Competition is in no way organized, sponsored, administered or endorsed by or associated with Instagram.
  8. The entity solely responsible for conducting the Competition is the Organizer, and the Participants agree to release Instagram from any liability that may arise in connection with organizing the Competition.
  9. Changing the Regulations requires publishing and informing the Participants about the changes made by the Organizer. Changes may be made only for reasons of adapting the Regulations to the standards of applicable law.
